Dispute Mediation
Many times when certain issues cannot be agreed upon in a family law case by the
parties, a court will order the parties to mediate. Mediation is a voluntary
process where a neutral third party attempts to facilitate an agreement between
the two parties who are in a dispute. Both parties’ lawyers are involved in this
process representing their respective clients. Therefore, an independent
mediator is necessary to facilitate an agreement between the parties.
Dispute Mediation in your Divorce or Child Custody Case
When you are represented by an attorney who is also a mediator, you have an
attorney that has similar training in mediation to that of the mediator, and
normally understands the principal goals and theories behind mediation. Not all
mediators are attorneys, and not all attorneys are mediators. Having a
representative who is both allows you to better understand the process and the
goal – to settle your case favorably without the need for a trial.
Dispute Mediation Principles in Negotiation
Often in family law cases, a significant amount of negotiation is done by
opposing attorneys over the telephone. The strategies attorneys use can impact
the results obtained for their clients. The use of mediation theories allows an
attorney to attach principles to each position in the negotiation, which often
assists in the resolution of family law cases. |
